MOTION NO. 46
MOTION: Councillor P. Gogarty
That the Chief Executive, in the section Growth and Housing, sets out as a strategic objective a review of Strategic Development Zones within the lifetime of each Development Plan so that deficits can be identified and amended if necessary by the elected members.
REPORT:
Both Adamstown and Clonburris planning schemes provide for reviews as part of their implementation. The Adamstown SDZ Planning Scheme 2014 provides for a mid-term review at Phase 6 (4,201-5,000 dwellings constructed and occupied). Similarly, the Clonburris SDZ Planning Scheme 2019 provides for a review as part of Phase 2 (2,001-4,000 dwellings constructed and occupied). The purpose in both cases is to ensure that the required infrastructure and facilities detailed in the Planning Schemes have been provided/are operational and that the overall Scheme is progressing in a satisfactory manner.
In addition to the above, Section 170A of the Planning and Development Act, 2000 (as amended) provides that a planning authority may make an application to An Bord Pleanála to request an amendment to a planning scheme. This would allow amendments for reasons including alignment with any changes to national and regional planning objectives.
A SDZ as adopted is deemed to form part of the Development Plan until revoked. Under the Planning Acts where there is a conflict between the development plan and the provisions of a Planning Scheme, the provisions of the planning scheme take preference. As the two SDZs in South Dublin provide for reviews it is considered that this motion is not one for the strategic direction of the draft Development Plan.
Recommendation: It is recommended that this motion is not adopted.
