QUESTION: Councillor S. Laing

"To ask the Manager to update this Councillor on the discussions, progress or lack of progress, concerning the site of the old Greenhills Shopping Centre in Limekiln Avenue, if the Council is in progress of taking enforcement action against the owners for the derelict condition of the lands, the likely time frame involved for developments to occur on this site and if he will make a statement on this matter?"

REPLY:

At the Meeting of Terenure / Rathfarnham Area Committee (1) on the 6th December, the members were informed that Planning Permission was granted by the Council in April 2004 for the construction of a three storey basement retail / apartment building at this location.  The site is being monitored, but to date no commencement notice has been submitted, indicating that it is proposed to implement the Planning Permission Granted, and the Council cannot force the developer to do so. 

Further inspections of the site have been carried out and accordingly maps / drawings are currently being prepared, and as soon as these are available it is proposed to commence the procedure to acquire the site by Compulsory Purchase Order under the Derelict Sires Act 1990.  This procedure involves giving notice of the Council's intention in the press and serving notice on the owners.  If objections are received, the matter must be referred to An Bord Pleanala for decision.  There is no time limit in the legislation for the Bord to confirm the Compulsory Purchase Order, accordingly it is not possible to establish a timeframe for the completion of the acquisition.  If the Bord confirms the Compulsory Purchase Order, and the Council are successful in acquiring the site, consideration must then be given to its future use.
