QUESTION: Councillor Eoin Ó Broin

To ask the CEO, in relation to new housing developments, where a developer undertakes to widen or improve an existing public road as part of conditions attached to planning approval for a housing development, what legal process is undertaken by SDCC to transfer maintenance and public liability insurance responsibility for the road to the developer and does the legal documentation specify a time limit by which the public road should be returned to public ownership or allow for periodic inspection of the road while in developers ownership to insure it is safe for public to use? And if he will prepare a report on same.

REPLY:

Where a developer or 3rd Party is required to carry out works on the SDCC land, the 3rd party will secure consent from SDCC to do works on our land. The land is not transferred to the 3rd party. When the 3rd parties contractor is working on the land they will assume all responsibilities for the Health and Safety and works associated for the period of time they are carrying out the works.
