QUESTION: Councillor F. Timmons

That the chief executive issue a report into when estates are taken in charge by SDCC does the green space land become council land and can it be considered for Housing ?

REPLY:

When housing developments and associated open space are taken in charge by SDCC, SDCC take a Deed of Transfer on the public open space taken in charge and become the owners.

Notwithstanding the ownership/ taking in charge status, any lands can be considered for housing or any development. The consideration / assessment of a proposal is through the planning application process (Part 8 for Local Authority development) and the compliance of the proposal with relevant national, regional and local policy/ guidelines and the proper planning and sustainable development of the area. For example, a proposal would be assessed for compliance with the relevant County Development Plan. It should be noted that not all public open space is zoned as ‘OS’ Open Space in the County Development Plan.

An area of open space may be considered for housing, however, relevant planning considerations on the principle of such a proposal include, and are not limited to, the land use zoning, conditions of previous permissions, policies and objectives of the Development Plan, Government Guidelines, quantum of open space in the area, traffic, and availability of sustainable transport mode options.
