MOTION NO. 21
MOTION: Councillor L. O'Toole
To ask That the Chief Executive looks at the area at Hayden’s Lane, next to Finnstown Hall, (as marked out on map), and consider this location as part of the council bio diversity plan. the records show from a previous motion raised, that the area marked was part of the Finnstown Hall development, however it seems no one is responsible for the area, and the developer may no longer exist. If the council could take ownership and transform this small area as it’s often commented on by many people who see it as an area that’s been left abandoned,
REPORT:
The subject item raises two issues in relation to a piece of land at Finnstown Hall. (Please note that the map was unavailable due to IT issues at the time of writing this response).
The first issue is the inclusion of same as part of the SDCC Biodiversity Action Plan. The public consultation on the Draft Biodiversity Action Plan was carried out in July/ August of 2020 and we have received 33 submissions. The deadline for submissions has passed. Rosaleen Dwyer, the SDCC Heritage Officer, is examining the submissions and issues raised to prepare a Chief Executive’s report. This report, with recommendations, will be brought to the Council at a future meeting. To date, I am not aware if this issue is raised in the Draft BAP submissions.
The second issue raised is in relation to land ownership of the lands. If the area was part of the Finnstown Hall development, the area may be due to come to SDCC as part of a Taking in Charge process. Queries with regard to taking in charge estates should be forwarded to the Building Control Section in the Land Use Planning and Transportation Dept. who manage and co-ordinate that process under the Planning and Roads Act.
