That the Chief Executive explains why no prosecutions appear to have issued, or attempted to be issued, in relation to the burning of materials (and dumping of materials into this site) on lands owned by the Council at the former temporary school site beside Foxborough, despite numerous complaints being made by residents - with the fire services being called on multiple occasions - and to clarify the cumulative cost to the Council of responding to calls and removing material from the site to date.

REPORT:
South Dublin County Council Environment Section, in conjunction with the Housing Section, have received numerous reports of dumping and burning of waste on lands adjacent to the illegal encampment on the old Scoil Oscair site, Balgaddy. Each of the reports received, have been unable to provide positive identification or witness statements identifying the persons involved, to allow for enforcement action to be carried out. Waste Enforcement Officers have inspected the site on numerous occasions following the reported incidences and have included it as part of ongoing monitoring. Following surveillance of the site by Waste Enforcement Officers in February 2020, an incident of illegal dumping was witnessed and follow up investigations are taking place to confirm the identification of the persons involved to allow for enforcement action in accordance with the Waste Management Act 1996, as amended. Following recent clean-up of the site by Housing Section contractors, Waste Enforcement Officers were able to retrieve evidence from the burnt waste that will allow enforcement action to be carried out on the person who produced the waste.
