MOTION: Councillor T. Gilligan

"That the Chief Executive agrees to build a wall between the Bawnogue Road and Ashwood Close due to anti social behaviour and rubbish issues."

REPORT:

Ashwood Estate was designed to allow for permeability and passive supervision. Ashwood Close is situated beside Bawnogue Road and was purposely left unenclosed to facilitate this permeability and enable access to bus stops on Bawnogue Road. The construction of boundaries is not a panacea to resolving anti-social or dumping issues and quite often can be counterproductive and lead to further problems such as graffiti, vandalism, fires etc. There are no current proposals to construct a wall at this location.

Residents who are experiencing difficulties with anti-social behaviour should be encouraged to report these incidents to An Garda Síochána who have the powers to enforce the law under the Criminal Justice (Public Order) Act.

The Council can take enforcement action through the Litter Pollution Act where evidence of polluters can be found in dumped material. This is often not possible due to the absence of evidence. A prosecution however may be possible where a witness is available to testify. Any member of the public who witnesses dumping taking place is welcome to contact the Litter Warden by emailing info@sdublincoco.ie or by telephoning 01 4149000 to help the Council take enforcement action under the Litter Pollution Act.

The Public Realm Section clean the Bawnogue area on a regular basis as part of scheduled works and will continue to do so. A review of the Ashwood Close area will be carried out with a view to providing signage to encourage people to refrain from dumping.
