MOTION: Councillor L. O'Toole

Considering that the school-time HGV ban has been in existence along the Newcastle road (N4 to Tandy's lane) for many years and also considering requests to ask for a report on the details regarding the number of fines if any that have been issue re this Ban, noting no such report/reply has been received to date, and considering the daily disregard by the many HGV drivers that don’t  abide by this restriction, this committee requests that the Chief Executive report on how a full time HGV ban could be introduced along the Newcastle road from the N4 to the Canal bridge and should the member agree and findings warrant such a ban this council supports a full time introduction.

What process would be involved to implement a ban, such as legislation etc?

REPORT:

The enforcement of the school time HGV ban is a matter for An Garda Siochana. A request for details of all the fines that have been issued will be requested and details will be circulated to this AC Members.

The introduction of a full-time ban is a matter for the Executive in consultation with Garda Commissioner as prescribed in legislation, namely the Road Traffic Acts.   A study of HGV through traffic will have to take place to establish a baseline for consideration. In turn an origin and destination study would provide guidance on the route such HGV's are taking. Alternative route(s) would need to be considered and the likely impacts that it / these may have. The findings would then be considered by the Executive in conjunction with the Garda Commissioner and interventions agreed where appropriate.

Given current resource issues within SDCC this study is unlikely to take place in the short term.
