MOTION NO. 2

MOTION: Councillor L. O'Toole

That this committee acknowledges the work involved between SDCC management and individual developers when preparing the required part 5 in each development. This committee requests the Chief Executive to confirm what practice is in place regarding the mix tenure of housing in each development. To also confirm what stakeholders are part of discussions regarding development design.

REPORT:

In accordance with the Planning and Development Act, 2000, (as amended) and Urban Regeneration and Housing Act 2015, 10% of all private developments are to be provided for social housing. Developers do engage before applying for planning permission and at this stage the Council sets out its requirements for Part V. The date of grant of planning permission is the key date for when Part V negotiations commence. This is after the development has been designed. This involves discussions with the Developers, their Quantity Surveyors and Valuers and the Council’s officials, Quantity Surveyors and Valuers. The Developer provides a proposal for Part V provision in respect of the approved planning permission. This proposal is then considered in accordance with housing need requirements of the area, unit types and sizing proposed with reference to the Department of Housing recommendations on unit sizing, value for money and funding provision.

When agreement is reached on the proposal, the Developer provides full construction costs in respect of the development and land costs as at the date of grant of planning permission. Construction costs are examined by the Council’s Quantity Surveyor. The land costs are examined by the Council's Valuer. These costs are then negotiated with the Developer’s Quantity Surveyor and Valuer. This negotiation process can take time between all parties involved before agreement is reached. The Council in negotiating and agreeing Part V units must take into consideration the Council’s housing strategy, housing need in the area and achieving value for money.
