QUESTION: Councillor William Joseph Carey
"To ask the Chief Executive what system they have in place to protect the rights and interests of Council Tenants affected by issues and disputes between a landlord and a management company.
Currently, there are incidents of Tenants in receipt of HAP in private apartment blocks who are being denied access to facilities and services that are available to other private renters and owner tenants?"
REPLY:
Tenants in receipt of the Housing Assistance Payment are not Council tenants. South Dublin County Council are not a party to the tenancy and have no role in any dispute or issues between the landlord, management company and tenants. HAP tenancies are covered under the terms of the Residential Tenancies Act 2004 (RTA) (as amended). This means that the tenancy agreement is, or will be, between tenant and landlord.
