To ask the Manager to detail the number of ongoing unresolved planning enforcement cases with which the Council is dealing?
REPLY
There are 701 active enforcement cases at present. Upon receipt of a written complaint alleging an unauthorized development, the Planning Enforcement Section examines the complaint. The length of time taken for resolution of an unauthorized development varies from case to case. The normal procedure is service of a Warning Letter, followed by the service of an Enforcement Notice. The developer has a right to apply for retention of the development. However, enforcement proceedings are not stayed by virtue of such application.
Of the 701 current cases;
54 are with the Council’s Solicitor for prosecution through the Courts
74 Enforcement Notices have been served recently
102 Warning Letters have issued following investigation and submissions are awaited
471 are under investigation (in some of these cases submissions received in response to Warning Letters served are currently under consideration)
