MOTION: Councillor M. Ward

As the property owners this Committee calls on the Council to use Section 45 of the Land and Conveyancing Law Reform Act 2009 to apply to the courts for a Works Order to deal with boundary related problem arising from neighbouring properties on behalf of its tenants in the North Clondalkin/Palmerstown/Lucan area

REPORT:

Generally, the Council's Housing Maintenance section state that the upkeep of trees, hedges and gardens in Council owned housing is the responsibility of the tenant. The management and maintenance of trees on private property is a matter for the landowner. The aim in the first instance would be to encourage property owners to engage with the Council and find solutions in these instances without having to resort to the legal process. If details of the specific locations could be supplied, the Council could the inspect the locations and liase with the residents to find a solution to this issue.
