QUESTION: Councillor Shane Moynihan
To ask the Chief Executive about the action being taken to address and prevent the burning of illegal waste (domestic and non-domestic) near the Scoil Oscair site on Griffeen Avenue, including contacts with the EPA and if he will make a statement on the matter.
REPLY:
Following a number of complaints which were received in relation to the burning of material at the Old Scoil Oscair Site in Balgaddy, Waste Enforcement and Housing Sections within South Dublin County Council have actively investigating this site. SDCC is the registered owner of the land in question, however a portion of site is currently being illegally occupied.
Waste Enforcement Section have carried out investigations on the site following reports of burning of waste on the lands. At all times during inspections no fires were evident, however remains of burning have been visible. To date, no evidence of the individuals carrying out the burning has been identified. Due to the lack of evidence found (to date), it has not been possible to carry out enforcement action in accordance with the Waste Management Act 1996, as amended.
The Council has commenced legal proceedings in respect of the illegal occupation of the site. The matter is for mention in the High Court in October.
