HEADED ITEM: L. Meeting Administration
Minimum Passing Distance Signs
REPLY:
On 28th February, the Minister for Transport, Tourism and Sport, Mr Shane Ross announced that legislation would be introduced to give effect to a minimum passing distance of 1.5m for vehicles overtaking cyclists (MPDL - minimum passing distance legislation). This followed a campaign of almost 5 years by Safe Cycling Ireland - Stayin' Alive at 1.5.This was to happen in a matter of weeks.
On 26th July the Department of Transport, Tourism and Sport informed Safe Cycling Ireland that the Attorney General's Office had difficulties with implementation of MPDL legislation. There were constitutional rights and practical rights that could not be overcome. MPDL was unlikely to happen in current format proposals.
The Department of Transport, Tourism and Sport is now proposing a new specific Dangerous Overtaking of Cyclists law with fines and penalty points. This has not happened yet.
As the MPDL legislation has not or will not be enacted it is not proposed to provide signage indicating a minimum passing distance for overtaking cyclists.
