QUESTION: Councillor J. Neville

"To ask the Manager for a detailed update on what legal action can or has been taken against *details supplied and will the Manager please note that this commercial premises is directly behind a residential estate and both light incursions and commercial activity are taken place both early in the morning and late at night and will the Manager make a statement on the issue?"

REPLY:

Following receipt of a written complaint, the lands at Unit 11 Broomhill Industrial Estate, Tallaght, Dublin 24 were inspected by the Planning Inspector.

A Warning Letter pursuant to Section 152 of the Planning and Development Act 2000 issued to the owner/occupier of the above lands on 2nd December 2005 in relation  to the erection of 2 no. high intensity lights at the rear of the premises and the erection of fencing that my not be considered to be exempted development.  As a person served with this letter, the owner/occupier may make submissions or observations in writing to the Planning Authority regarding the contents of the Warning Letter within four weeks of the date of the service of the letter.

A submission received in response to the Warning Letter is currently under consideration by Planning Enforcement and a decision on the service of an Enforcement Notice in relation to this matter will be made shortly.

The Environmental Health Officer has been requested to investigate and comment on the intensity of the illumination provided to the rear of the premises.

The Councillor will be kept informed as this investigation progresses.
