MOTION: Councillor B. Bonner
"That this committee calls on the Chief Executive to present a report on the efforts that have been made to ensure that businesses in the Clondalkin area fulfill their legal obligations with regard to ensuring that their property and the areas around them are litter free.
There are particular difficulties in relation to the following businesses and the land around them.
1. The Steering Wheel Pub and its car park. Main Street. Clondalkin
2. The ethnic Supermarket at Elmfield, Ninth Lock Road, Clondalkin.
3. The former CB Packaging site , which adjoins the Mill Centre on Ninth Lock Road, CLondalkin.
This committee acknowledges the efforts of the Litter Warden at these locations and asks for a report on those efforts and an outline of the plan to ensure that the owners of these premises comply with the law."
REPORT:
Section 6 of the Litter Pollution Act 1996 as amended, (the Act) requires the occupier of a public place to keep the premises and adjoining area free of litter.
Section 3.1 of the Council's By Laws for the prevention and control of litter, outlines the responsibility of the occupier of a premises. The occupier shall, if required by an authorised officer, at the occupier's own cost, provide an adequate number of litter receptacles immediately outside their premises, of suitable design and size, with specifications, location and number to be approved in advance by the Council.
The owner or person responsible for a place to which the public has access is required to keep the area adjoining their premises litter free, regardless of how the litter got there. This places an obligation on business people to:
Where it is apparent that an occupier of a premises is contravening Section 6 of the Act, or that precautionary measures are required to prevent the creation of litter, the Council may serve a Notice on the occupier of the premises requiring the occupier to remove the litter or take precautionary measures, specified in the Notice issued pursuant to Section 9 of the Act, which the Council considers necessary. Failure to comply with the Notice may result in the issuing of a litter fine to the occupier.
Our Litter Warden service is very visible in the Clondalkin area and a good working relationship has been developed with the businesses. The Litter Warden patrols this area three to four times weekly.
While it is not proposed to outline specific details relating to persons/ entities, to date in 2018 (up to 12th April), a total of nine notices and two fines in respect of businesses in Clondalkin.
