MOTION NO. 14

MOTION: Councillor M. Duff

"That this Area Committee calls on the Chief Executive to extinguish the Right of Way on the pathway adjacent to the Gable wall of 1 Raheen Drive, Tallaght, Dublin 24. This pathway runs from Raheen Drive to Raheen Court and crosses through the centre of the land attached to 1 Raheen Drive, under Folio Number DN1637F.

REPORT:

"The extinguishment of the Public Right of Way over existing pathway and open space was brought to the full Council Meeting on 13th December, 2010 and the following is an extract from the meeting:-

"South Dublin County Council in pursuance of its power under Section 73 of the Roads Act, 1993 hereby orders that the procedure to extinguish the public right of way over existing pathway and open space along side of 1, Raheen Drive, Tallaght, Dublin 24 as outlined in red on map marked 1355-02, not be initiated.”

If there is consensus now for the extinguishment of this footpath by all residents the Council will iniatiate the process again.  This strip of land is in the ownership of the householder living at no. 1 Raheen Drive."
