MOTION NO. 22

MOTION: Councillor W. Lavelle

"That this Area Committee requests the Chief Executive to provide a detailed update, for discussion, on the examination of planning enforcement complaints relating to the erection of gates at Weirview Cottages which enclose and prevent access to land which was habitually open to and used by the public during the preceding 10 years; and which are further detrimental to the character of Weirview Cottages, all 20 of which Protected Structures; and which forms part of an Architectural Conservation Area."

REPORT:

The laneway in question previously formed part of an enforcement investigation. The Planning Authority concluded that there is no evidence of a public right of way for the general public at this location and accordingly no enforcement action available to the Council. The erection of the gate at this location is considered exempted development, does not endanger any protected structure, and accordingly a civil matter between the house owners in question. It is also considered that the erection of a gate does not detract from the objectives of the Architectural Conservation Area.
