MOTION NO. 1

MOTION: Councillor W. Lavelle

"That this Area Committee requests the Chief Executive to present a detailed report, for discussion, on efforts to remove fallen trees and heaps of dumped earth and other materials from the embankment south of Lucan Road, adjoining the rear of houses at Esker Lawns, noting the repeated concerns expressed by both Lucan Tidy Towns and local residents in relation to the increasing risk of slippage of material down the embankment onto the footpath and road below"

REPORT:

"The Council is familiar with the location and has recently established that the lands in question is not in Council ownership and has not been taken into charge.

Given the situation as it exists on the ground,  Environment, Climate Change & Water Department (Enforcement & Licensing Section) recently issued letters to neighbouring residents (Esker Place) advising of their obligations under the Litter Pollution Act 1997, as amended, enclosing a leaflet "Litter and the Law" for their reference.  Similarly, residents have been advised that all organic and green waste should be placed in the brown bin, and can also be taken to the Ballymount Civic Amenity Centre for disposal.

The issue of "dangerous place" nature of the location is more complex.  Regrettably having made communication with who was believed to be the owner, Council was recently formally advised that the lands have been subsequently sold and new owners have not yet registered file with the Property Registration Authority.

Nonetheless, notwithstanding that the recent land transaction registration appears not to have yet concluded, communications will issue to the "new" owners advising of their obligations as landowners to prevent this area from being a potentially dangerous area."
