MOTION: Councillor J. Graham
"That this Committee calls on the Management to identify the legal owner of the lands adjacent to *address supplied* and issue enforcement proceedings to the owner under the Litter Pollution Acts."
REPORT:
The lands referred to were recently brought to the attention of the Councils Enforcement & Licensing Section.
The Council's Litter Warden investigated the complaint and found a large amount of material being held on the lands in question on 6th October 2015. However, when the Litter Warden returned on the following day, 7th October 2015, it was found that this particular material had been moved onto the open space at St. Marks Estate. This material was subsequently removed by the Council’s Public Realm Section on that same day, along with other material dumped on the open space.
The Council has carried out a Land Registry search in order to identify the registered owner of the lands. Unfortunately, the ownership details do not reflect the change of ownership which took place approximately five years ago. The Enforcement and Licensing Section is trying to establish the identity and whereabouts of the current owner.
A recent inspection found that the lands are littered. The Litter Warden will continue to monitor the situation and any action warranted under the Litter Pollution Act 1997, as amended, will be taken once the ownership details are established.
