MOTION: Councillor B. Bonner
"Can the Chief Executive clarify whether take away premises can be prosecuted for boxes and wrappers which are clearly marked with their logo and emanating from their business being discarded by customers. There is a particular problem with one pizza outlet *name and address supplied* Customers discard the pizza boxes all around the village, but particularly along the Monastery Road. The area adjacent to the Monastery Shopping centre is often very badly littered with these boxes. This committee calls on the Chief Executive to request that this pizza shop organise a clean up of the surrounding area of it's discarded boxes at close of business each evening."
REPORT:
In general where it is apparent that an occupier of a premises is contravening Section 6 of the Act, or that precautionary measures are required to prevent the creation of litter, the Council may serve a Notice (under Section 9 of the Act) on the occupier of the premises, requiring the occupier to remove the litter or take precautionary measures specified in the Notice, which the Council considers necessary.
Failure to comply with a Notice may result in the issuing of a litter fine to the occupier.
The Council's Litter Warden Service is very visible in the Clondalkin area, and has developed a good working relationship with businesses. There are daily patrols in the Clondalkin Village area, at different times of the day.
He is satisfied that all the businesses are aware of their obligations under the Litter Pollution Act 1997, as amended, and he works with them to deal with any specific problems which may occur.
It should be noted that Section 6 of the Act relates to an occupier's obligations to keep any area in the vicinity of the premises, visible from a public place, free of litter, and regardless of the source of the litter and this extends beyond, and includes, litter generated by the occupiers of any property.
