Update report in respect of the disposal at Foxdene, Balgaddy to the St Laurence O’Toole Trust approved at the Council meeting on 9th June 1997.

REPLY:

Following consideration of a report at the O & P & F Committee meeting of Council held on 17th September the members agreed that:

  1. The current project status be reviewed in conjunction with the Community Department.
  2. The views of the other side in the transaction, (St. Laurence O’Toole Trust), be sought.
  3. A full report on the project then be brought to the Area Committee for consideration and possibly to full Council for decision.

As agreed, the situation has been reviewed and the following is the position.

As confirmed in the report to O & P the disposal is the subject of an approved S 183 report, (a function reserved to the members), and any proposal not to proceed with same would have legal implications both for the current project and the application of S 183 procedures generally.

  1. Having reviewed the project, including the Bush Centre operations and related projects, it is recommended that the disposal should proceed. The disposal will enable the continuation of service delivery to the local community.
  2. The St Laurence O’Toole Trust legal representatives have indicated that they wish to proceed with the acquisition and have sought a closing date for same.
  3. The Law Dept have been instructed not to identify a closing date pending this report. However, it is strongly recommended that the S 183 disposal proceed in accordance with the 1997 approval.
  4. Should the Area Committee decide not to accept this recommendation and recommend an alternative action to full Council, as outlined above, legal advice will be sought in relation to the proposed action and a further report in the matter will be brought to the O & P & F Committee of Council for consideration.
