MOTION NO.13

MOTION: Councillor B. Bonner

"That this area committee request the Chief Executive to present a report on what action has been taken by the litter warden service on pizza and fast foods outlests in Clondalkin Village.  The worst areas are the corner of Orchard Road/Monastery Road and the Tower Shopping Centre on Tower Road."

REPORT:

Section 6 of the Litter Pollution Act 1997, as amended, (the Act) requires the occupier of a public place to keep the premises and adjoining area free of litter.

Where it is apparent that an occupier of a premises is contravening Section 6 of the Act, or that precautionary measures are required to prevent the creation of litter, the Council may serve a Notice (under Section 9 of the Act) on the occupier of the premises, requiring the occupier to remove the litter or take precautionary measures specified in the Notice, which the Council considers necessary. 

Failure to comply with a Notice may result in the issuing of a litter fine to the occupier. 

While it is not possible to provide a breakdown of the number of Section 9 Notices issued in the Clondalkin Electoral Area, a total of 137 have been issued in the County to date in 2015.

The Council's Litter Warden patrols the Clondalkin Village area on a daily basis, at different times of the day. The Litter Warden is very visible in the Clondalkin area and has developed a good working relationship with the businesses.  He is satisfied that all the businesses, including those mentioned in the Motion, are aware of their obligations under the Litter Pollution Act 1997, as amended, and he works with them to afford them an opportunity to deal with any specific problems which may occur, before resorting to enforcement action. 

Working with the business community and adopting a reasonable approach has proven to be successful.  However, a zero tolerance approach is taken with repeat offenders.

The Council's Litter Warden called to both premises mentioned on Monday, 12th October 2015 at approximately 11.30am and again on Tuesday 13th October 2015 at approximately 12.00 noon. Both premises were found to be free of litter on both days and these area will continue to be closely monitored.
