MOTION NO 7.
MOTION: Councillor M. Genockey
That this committee requests that the Council reviews its policy of not replacing or fixing windows, doors or similar fixtures in Council houses that have been the victim of crime, including burglary or anti-social behaviour.
REPORT:
The Council’s Tenancy Agreement provides as follows;
The Tenant shall be responsible for all internal decoration and for any breakage of glass in the windows and any damage to the fixtures, fittings or structure of the dwelling and shall cause to be made good any damage or breakage without delay and where such works, damage or breakage is carried out or repaired by The Council, the tenant shall pay the cost of such works to the authority.
(a) The Tenant(s) shall be responsible for the repair of any wilful or malicious damage and if the Council undertakes repairs resulting from such damages the cost of such repairs will be charged to the Tenant(s)
(b) The Tenant(s) shall be responsible for repairs to doors, windows, fixtures and fittings in the dwelling caused by destruction or damage by burglary, housebreaking, larceny or theft.
While it is not intended to review the terms of the tenancy agreement any serious damage caused by acts of anti-social behaviour are looked at on a case by case basis where discretion may be used.
