QUESTION: Councillor G. O'Connell
"To ask the Chief Executive for an update report on the Council owned piece of land at Palmerstown Lawns and to ask that the Council engage with the adjoining householder and Palmerstown Court Residents Association to resolve the outstanding issues so that the site in question ceases to be a problem?"
REPLY:
The subject piece of open space land is registered in Council ownership and its rear boundary wall abuts Palmerstown cemetery. The plot contains significant public services and therefore requires to be accessible to the Council for maintenance purposes
The Council received representations from both the Palmerstown Court Residents Association and an adjoining house owner to incorporate the subject plot into the curtilage of that of the adjoining house owner for garden and maintenance purposes in an effort to abate anti social behaviours on the plot and its use as an access into Palmerstown cemetery.
A number of discussions took place with the house owner and representatives of the resident association on the matter of fencing and appropriate boundary treatment of the plot to facilitate good land management and access requirements prior to consideration of making the plot available to the adjoining house owner. A fence was erected by the Council on the site in November 2014. In accordance with the advices of the County Law Agent, licence terms were subsequently proposed to the house owner for incorporation of the plot into their boundary for garden and maintenance purposes. The house owner has expressed dissatisfaction with the proposed terms and has requested further negotiation on the matter.
A meeting has been arranged for early July with all relevant parties in an effort to bring matters to a conclusion in a manner satisfactory to all parties.
