QUESTION: Councillor F.N. Duffy
"To ask the Chief Executive that a resident of Brookvale Downs witnessed SDCC trees being cut down to the west of Brookvale Downs. She very courageously followed the perpetrator, while liaising with the Garda at the same time. A SDCC official visited the site in question to record the damage. What type of action can be taken by SDCC when this practice happens to compensate those who loose their amenity?"
REPLY:
It is alleged that a tree was recently removed without authorisation from the open space area to the rear of Brookvale Downs which fronts onto Dodder Park Road/Springfield Avenue. The matter is currently under active investigation by the Gardai from Rathfarnham Garda Station. Unauthorised damage, pruning or removal of a Council owned/managed tree may be prosecuted by an Garda Síochána under the Criminal Damage Act 1991. The Council is assisting the Gardai at Rathfarnham in their investigation of the matter.
