MOTION: Councillor J. Lahart
"That this Committee agrees that a Local Area Plan specifically for the Scholarstown/Stocking Lane/Stocking Avenue/Boden Park/Woodfield/Brookwood/Templeroan area is needed in order to properly future plan developments in the area that have an immediate impact on the locality, not least, from a traffic management perspecitve."
REPORT:
Section 19 of the Planning and Development Act 2000 as amended sets out the criteria for the preparation of a Local Area Plan. Local Area Plans may be prepared for areas which "the planning authority considers suitable and, in particular, for those areas which require economic, physical and social renewal and for areas likely to be subject to large scale development within the lifetime of the plan." Section 19 of the Planning Act also states that:-
"A Local Area Plan shall be made in respect of an area which-
(i) is designated as a town in the most recent census of population, other than a town designated as a suburb or environs in that census,
(ii) has a population in excess of 5,000, and
(iii) is situated within the functional area of a planning authority which is a county council.
It is considered that the Area in question largely comprises modern, privately owned housing and does not require economic, physical and social renewal. The Area will not be subject to large scale development, nor is it an area for which the preparation of an LAP is a statutory requirement.
It is therefore considered that the preparation of LAP for this area would not be a priority in the context of statutory requirements which must be undertaken.
