QUESTION: Councillor L. O'Toole

To ask the Chief Executive how many fines have been issued throughout the county in relation to Dog Litter and how many successful if any prosecutions

REPLY:

Section 22 of the Litter Pollution Act 1997, as amended, requires that any person in charge of a dog shall immediately remove faeces that has been deposited by the dog and shall ensure that it is properly disposed of in a suitable sanitary manner. 

It is widely acknowledged that problems arise in enforcing this Section of the Act due to the difficulty in identifying the person in charge of the dog.  The Council is dependent on the assistance of the general public in providing witness statements.

In 2014 three fines were issued under Section 22 of the Act.   No fines have issued as of yet in 2015.
