QUESTION: Councillor G. O'Connell
"To ask the Chief Executive if any approaches have been made to this Council in relation to the recently extended planning permission for the site at the junction of the R148/Palmerstown Village and if the Chief Executive would inform this Committee what the position would be if the review of the County Development Plan now underway were to restrict the height of building in this general area?
REPLY:
Planning permission was granted on 14th January 2015 to extend the duration of permission of SD09A/0021. This permission will now expire on 20th May 2020. Any restriction on building height in the general area that would form part of the County Development Plan review would take effect from the date a new County Plan is made, which will be July or September 2016. Any such restriction on building height could not retrospectively apply to an existing planning permission. The consequence of introducing a restriction on building height when planning permission for development is already in place could be that it might give a developer no option but to implement the existing permission. This may arise if any possible alternative development is restricted to a significant extent, as it would limit the scope for compromise.
