QUESTION: Councillor P. Donovan
"To ask the Chief Executive for a report on protected structures in our area. Please include in the report a full list of those structures and provide details on the process for a. designating something a protected structure, b. the decision/appeal process for a protected structure?"
REPLY:
There are currently 554 Protected Structures included on the Record of Protected Structures (RPS) under Schedule 2-County Development Plan 2010-2016. The majority of Protected Structures within our County are located in the areas of Rathfarnham, Terenure and Tempelogue area. The structures and features listed within the RPS provide a high quality of architectural variety, styles and features of interest.
A copy of the Record of Protected Structures is attached and those structures/features located within the Rathfarnham, Terenure and Tempelogue area are highlighted. There are a total number of 149 Protected Structures in this area included on the RPS.
With regard to adding a structure/feature to the Record of Protected Structures this procedure is detailed under Part IV of the Planning & Development Act 2000 (as amended).
Under Section 54 (1) of the Planning and Development Act 2000 A planning authority may add to or delete from its Record of Protected Structures a structure, a specified part of a structure or a specified feature of the attendant grounds of a structure, where –
(a) the authority considers that –
(i) in the case of an addition, the addition is necessary or desirable in order to protect a structure, or part of a structure, of special architectural, historical, archaeological, artistic, cultural, scientific, social or technical interest, whether or not a recommendation has been made under Section 53, or
(ii) in the case of a deletion, the protection of the structure or part is no longer warranted, and
(b) the addition or deletion is made when making a development plan under Part II or in accordance with Section 55.
The making of an addition to or deletion form, the Record of Protected Structures is a reserved function that is a matter for the elected representatives.
