MOTION: Councillor J. Lahart

"That the Chief Executive outline what steps have been taken to date - including a detailed dated account of meetings and requests regarding the transfer of title to Gaelscoil Chnoc Liamhna of the land on which their school is located and to give a timeline for the transfer of same." 

REPORT:

Gaelscoil Chnoc Liamhna is located in temporary accommodation on a South Dublin County Council owned site at Knocklyon Road, Dublin 16 since circa 2001. The Council agreed to dispose of this site to the Department of Education and Skills in February 2007 to enable permanent school accommodation to be provided on the site.

However difficulties have arisen in transferring good title to the overall site to the Department, as part of the old Knocklyon Road which traverses the site is unregistered title. The Council has endeavoured for several years to register title to this strip of land but the Property Registration Authority has to date, queried the options put forward by our legal advisors.

A number of options have been investigated with a view to enabling title to all or part of the site to be transferred to the Department and the matter is subject of regular discussions with the Department who will have sought their own legal advice in this matter.

It is understood that the Department recently undertook a technical survey of the site and it is expected that a decision will be made in the near future as to what option to pursue next with a view to enabling a permanent school building to be constructed on site.
