QUESTION NO. 11

QUESTION: Councillor F.N. Duffy

"To ask the Chief Executive that South Dublin County Council monitor fly tipping at Stocking Avenue as domestic waste is currently being dumped here on a near daily basis?"

REPLY:

In 2014, the Council's Litter Warden Service investigated twenty (20) complaints received in relation to illegal dumping on Stocking Avenue, which resulted in the issuing of three (3) litter fines in accordance with the Litter Pollution Act 1997, as amended (the Act).  To date in 2015, the Council has received 3 complaints and one (1) fine has issued.  No enforcement action could be taken for the balance of complaints due to lack of evidence or difficulty in identifying offenders.  Increasingly, it is found that no personal information relating to the polluter is contained within the dumped material with personal information having been shredded or removed.

The Litter Warden patrols this location on a regular basis in line with his patrol. If and when he observes bags of rubbish illegaly dumped, he interrogates the dumped material for evidence and takes the appropriate enforcement action under the Act where possible.

Where there is an ongoing problem of illegal dumping and littering in any area, local residents are encouraged to support the Council in taking the appropriate enforcement action by making reports to the Litter Warden for investigation and by providing evidence where possible.

Members of the public can make reports of illegal dumping and littering through the following channels:
