QUESTION NO. 10

QUESTION: Councillor F.N. Duffy

"To ask that this Committee write to the owner of Marlay Grange House expressing grave concern at the noise levels, duration and unreasonably late finish of the party held there on November 1st, 2014 and taking into consideration the amount of residents from South Dublin CC area distressed by this social function, ask that this type of event with noise levels of this volume never occurs again?"

REPLY:

The Principal Environmental Health Officer reports that his department were in direct contact with the owner of Marlay Grange House on Monday 3rd November regarding the concert event that was held on the previous Saturday night. He also states that South Dublin Environmental Health Department was unaware of the staging of this event and informed the owner that if he intended to repeat such events, that SDCC would be requiring a minimum of 4 weeks advance notice in writing of the exact nature of the concert, the numbers attending, details of the performing bands, the location of any stage areas, and the expected duration. He was also informed that any repeat of the unacceptable level of noise nuisance that existed on the night of 1st November, would result in prosecution.

Environmental Health has since liaised with the Gardai in Rathfarnham and Blackrock on a planned joint approach regarding restrictions should such an application be received. Environmental Health has also advised Barnardos, who was the beneficial charity of the income derived from this charity event, that the level of noise and duration of the event was totally unacceptable and that such circumstances would not be allowed to reoccur should a concert be envisaged in conjunction with the owner of Marlay Grange House next Halloween.
