QUESTION: Councillor B. Bonner
To ask the Chief Executive could the planning permission granted for the development of a new boundary wall at name and address supplied* be compared to what has actually been built at this location? I find it hard to believe that permission would have been granted for a wall that blocks a public footpath into the estate and completely changes the vista at the end of the cul de sac.
REPLY:
An Enforcement Notice pursuant to Section 154 of the Planning & Development Act 2000 (as amended) was served on the owners of the lands referred to above on 4th February 2011 requiring the following:
(i) Erect a retailing wall and railing along the line indicated on the approved Site Layout Plan, (Dwg. No. 02/03 (18-04) 993) and in accordance with written agreed details, between the driveway to the house and the adjoining area of open space to the east.
(ii) Provide a separation concrete kerb as indicated on the approved Site Layout Plan (Dwg. No. 02/03 (18-04) 993), between the driveway of the house and the adjoining area of open space to the north.
(iii) Make good the surface of the area of the adjoining open space to the north disturbed by the carrying out of works.
(iv) Replace as necessary part of the open space area to the east of the retaining wall which was removed as accommodation works. The replacement works to consists of soiling to the necessary depth and finished to match the sloping level of the open space to the north, and seed.
The file was closed on 6th July 2011 following compliance with the terms of the Enforcement Notice as there was no further action warranted by the Planning Authority in the matter at that time.
