The Council acquired Plot 36 of the South Dublin County Council Compulsory Purchase (Outer Ring Road – Balgaddy to Kingswood) Order, 2001 on 26th April 2004.

On completion of the acquisition an area of land measuring 90 sq. meters approximately in excess of that which was the subject of the Compulsory Purchase Order was registered to the Council. This has been confirmed by the Property Registration Authority.

An application has now been received by the receivers in respect of the current owners of the land to have this area of land transferred back to them as it is within the curtilage of their property.

Accordingly, I recommend that subject to the provisions of Section 183 of the Local Government Act, 2001 and in accordance with Section 211 of the Planning & Development Act, 2000, the Council disposes of its interest in the area shown outlined red on Drawing CA297/36 to Simon Kelly, Patrick Kelly and Simon Arnold c/o Kieran Wallace, Receiver, KPMG, 1 Stokes Place, St. Stephen’s Green, Dublin 2, receivers for Maldron Hotel Citywest/Kingswood Country House, Naas Road.

The lands being disposed of form part of lands which were acquired from Gledswood Limited in 2004 for road purposes.
