Disposal of Fee Simple Interest in lands referred to as Sites D & E Rowlagh Village, Clondalkin, Dublin 22 to Brendan Farrelly

The Council at its meetings held on 12th November 2001 and 14th October 2002 approved the disposal, by way of agreement to lease and long lease, of two sites marked as Site D & E Rowlagh Village, Clondalkin, Dublin 22 to Mr. Brendan Farrelly for the provision of residential development. These sites formed part of the Clondalkin Integrated Area Plan. Minute No. C/537/01 refers. These sites have since been developed, Site D now comprises of five townhouses known as Chaplains Row and Site E comprises of 20 apartments known as Chaplains Terrace.

The terms of the disposal agreement provided an option to the Lessee to acquire the freehold title to the lands on satisfactory completion of the development, as set out in Clause 4 of Minute No. C/545/02 which states as follows:

 "The Lessee will have the option to acquire the Council’s fee simple interest in the relevant property for the sum of €500 (five hundred euro) plus the proper legal costs of transfer on satisfactory completion of the development as certified by the County Architect together with all landscaping works as certified by the Senior Parks Superintendent and vehicular and pedestrian access and egress arrangements as certified by the Director of Transportation.”

The Lessee has now confirmed that he wishes to exercise this option.

Accordingly, I recommend that the Council dispose of the Fee Simple Interest in the two sites at Rowlagh Village, Clondalkin, Dublin 22 as shown outlined in red on Drawings Nos. LR/48/14 and LR/49/14 to Mr. Brendan Farrelly for the sum of €500.00 in accordance with Section 211 of the Planning and Development Act 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 and subject to the following condition:

  1. That the Council shall reserve a wayleave where necessary over the subject sites and in particular over the area shown shaded in yellow on Drawing No. LR/48/14 for the purpose of accessing existing services laid therein.

The lands being disposed of form part of the lands acquired from Dublin City Council (formerly Dublin Corporation) in 1997 under the Scheme of Transfer of Houses and Lands pursuant to the Local Government (Dublin) Act, 1993.
