Cathaoirleach's Business:
That this Committee agrees that in light of the negative impact of ongoing commercial developments on land adjacent to the small rural population on the Baldonnell Rd the Council, in consultation with the residents will provide a community dividend to this community.
REPORT:
The statutory provision for community gain in respect of commercial development is governed by Section 48 of the Planning and Development Act 2000 as amended. Section 48 states that "A planning authority may when granting a permission…include conditions for requiring the payment of a contribution in respect of public infrastructure and facilities benefitting development in the area" and that the contribution "shall be set out in a development contribution scheme made under this section…” The current SDCC Development Contribution Scheme dates covers the period 2013-15 and currently requires a contribution of 78.68 euro per square metre of commercial development. All contributions levied are used to fund projects that benefit the community as a whole, as set out in a schedule referred to in the Document. The Scheme is likely to be reviewed in 2015. The impact of specific development proposals is assessed at planning application stage and if considered significant, may be subject to ameliorative measures, which are generally site-specific.
