QUESTION: Councillor J. Lahart
To ask the Chief Executive for the number of litter fines issued in the county to date this year together with penalties and summonses?
REPLY:
The Council's Litter Warden Service has issued a total of 419 litter fines in accordance with the Litter Pollution Act 1997, as amended (the Act) from 1st January 2014 to 31st August 2014, amounting to €62,850. A total of 208 Notices have also been issued under the Act.
54 cases have been listed for Court hearing for prosecution for non payment of litter fines, of which 22 cases have been heard with 13 succesful outcomes.
Cases can be unsuccessful for various reasons such as fines been struck out due to payment of litter fine being made on the day, struck out due to witnesses not turning up in court, the Judge finding in favour of alleged polluter and in some cases the Judge allowing the alleged polluter additional time to pay.
