Proposed disposal of land to John and Jean Berns, Gerard Berns and Ciaran Reilly at Mill Road, Saggart, Co. Dublin

The Council agreed terms for the acquisition of lands from John and Jean Berns in February 1993, in accordance with the Dublin County Council (Saggart/Rathcoole Link Road and Open Space) Order, 2984. One of the conditions of the agreement states as follows:-

          “Dublin County Council shall, upon completion of the road works, cede back to the

          Claimants a strip of land of at least three (3) metres depth fronting plot 12 and 13”

However, following the completion of the road this was not done and the Council inadvertently became registered to all of the land contained in these two plots. This needs to be rectified.

The Vendor of the original lands has since disposed of two sections of his landholding and has now requested that the lands be transferred to these individuals and to him as follows;

          John and Jean Berns, Drawing No. LA/30/14 having a nett area of 0.0145 hectares.

          Gerard Berns, Drawing No. LA/31/14 having a nett area of 0.0143 hectares.

          Ciaran Reilly, Drawing No. LA/32/14 having a nett area of 0.0026 hectares.

Accordingly, I recommend that subject to the provisions of Section 183 of the Local Government Act, 2001 and in accordance with Section 211 of the Planning & Development Act, 2000, the Council disposes of its interest in the areas shown outlined in red on Drawing LA/30/14 to John and Jean Berns, LA/31/14 to Gerard Berns and LA/32/14 to Ciaran Reilly.
