QUESTION: Councillor Liona O'Toole
To ask the Chief Executive does South Dublin CC have any input or control of the issuing of permits to Waste Collection companies who operate within the SDCC region and does SDCC have any powers or influence in the revoking of permits?
REPLY:
The collection of waste on a commercial basis requires a waste collection permit from a relevant local authority in accordance with Section 34(1) of the Waste Management Act 1996 (as amended). The Regulations set out procedures for the making of permit applications, public consultation, consideration of submissions in relation to permit applications, and the grant, refusal and review of permits by local authorities.
As and from lst February 2012, Offaly County Council was designated as the Nominated Authority for the processing of all new Waste Collection Permit applications and review applications received on or after that date. This single Nominated Authority became the National Waste Collection Permit Office.
South Dublin County Council has no powers to revoke Waste Collection Permits as these powers are only available to the authorising body - in this case, now the National Waste Collection Permit Office.
