MOTION: Councillor E. Ó Broin
This Committee agrees that the manager should table a report for discussion at the meeting on the outstanding management fees owed by South Dublin County Council to the management company at the Bawnogue shops. The report should include the total amount of monies owed by the Council, the period for which these fees are due and the reason why the Council has not paid the fees. This Committee also agrees that the Council should now make arrangements to pay these outstanding fees as a matter of urgency in order to assist the management company raise the funds for the resurfacing of the carpark which is currently in a very dangerous condition.
REPORT:
The Council repossessed flat no 2 Bawnogue Shopping Centre in 1989 on the basis of a Court Order against the former borrower at that time. The Council subsequently registered it's interest in the property. No liability for management fees is included in the Councils title to the property
This unit was let on a nominal rent to the DBD Neighbourhood Unemployed Drop in Information Centre. They have been in occupation of the property for approximately 20 years. At no stage during that period did the question of a management fee arise. The Council has over the past number of years carried out extensive maintenance on the unit and its roof at considerable expense.
Following inquires it appears that the Bawnogue Traders formed an Association and have endeavoured to have all units contribute €20 per week to the maintenance of the shopping centre. The Council were not party to that decision and would have resisted it had we been informed at the time. The Council do not accept that there is any management fee payable in respect of this property.
The car park at the shopping centre is in private ownership and its resurfacing is a matter for the owners.
