QUESTION NO. 3
QUESTION: Councillor E. Ó Broin
To ask the Manager why Question No 5 at the March 2014 Area Committee (which referred back to Motion 23 at the December 2013 area committee) was not answered correctly and to ask the Manager to provide a proper answer to the question as asked.
REPLY:
The reply to the last Clondalkin ACM indicated behind the scenes work had been undertaken to establish exactly who the stakeholders in the area were and to give an overview of the situation. It should also have stated that it had proven impossible to contact the adjoining landowner who is one of the major stakeholders.
The most pertinent aspect of this site is that the lane way is partially owned by the adjoining landowner and a Right of Way exists over it. The lane way is not in charge of the Council and we are only empowered to extinguish a ROW over lands we have in charge.
However to date extensive efforts have been made to contact the private landowner in question here to no avail. A letter has issued and a response is awaited. Most recently staff members called out to this house but no reply was obtained. It should be noted that previous attempts to engage with him proved unsuccessful, particularly during the course of the Part 8 proposal for the nearby site.
It should also be noted that the Councils Anti Social Team are not in receipt of any complaints from residents in regard to this location. Recent inspections have shown the area to be in good order despite a couple of bags of rubbish dumped there. There is no evidence of bush drinking on the lane way with the consequent disposal of bottles and cans. In addition, it was noted that the laneway is utilised by residents from St. Marks Green into St. Marks Crescent as a walk way between the 2 areas.
The Councils Litter Warden visited the area on 15th April and observed approximately four black bags of rubbish on the grounds of the private property which is accessed via the laneway. The site in question is also overgrown. The Litter Warden tried to enter the site to speak with the owner but the gate was locked. A card has been left for the owner to contact the Litter Warden
If the owner of the private site contacts the Council a meeting with all departments who have a responsibility here will be called.
