QUESTION NO. 14

QUESTION: Councillor E. Ó Broin

To ask the Manager for an update on the planning compliance issue on planning permission granted under Register Reference SD07A/0280 at Profile Park and detailed in members representation reference S7420 and with particular reference to those elements of the planning permission that relate to the Baldonnell Road.

REPLY:

Complaints have been received by the Planning Authority in relation to Non-compliance with Planning Permission granted under Register Reference SD07A/0280 with regard to the following Conditions;

2.a)The use of the proposed haul road shall cease after construction of the development.

12.a) Protective fencing shall be provided for the western boundary hedgerow to exclude construction traffic and materials and protect the existing hedgerow. A scheme of Protective fencing to B.S. 5837:2005 for the western hedgerow boundary shall be submitted for the written agreement of the Planning Authority prior to the commencement of the general construction on the site.

b) Details for the re-instatement of the boundary to the Baldonnell Road following discontinuation of use of the temporary access haul road shall be submitted for agreement with the Planning Authority. The roadside boundary shall be re-planted not later than the first season following discontinuation of use of the temporary road.

A Warning Letter issued to the owner/occupier in relation to the above on 1st April 2014. As a person served with this letter the owner/occupier may make submissions or observations in writing to the Planning Authority regarding the above (which, if true, would constitute an offence under the Planning & Development Acts, 2000 (as amended) not later than four weeks from the date of the service on the owner of the Warning Letter, i.e. 1st May 2014.

Should the Planning Authority, following investigation, consider that the above described or other unauthorised development has been carried out, it may decide to issue an Enforcement Notice under Section 154 of the Planning and Development Act, 2000 (as amended).
