Re: Proposed disposal of ESB Sub Station Site at Neilstown Centre, Clondalkin, Dublin 22

An application was received from the Electricity Supply Board, Clanwilliam House, Clanwilliam Place, Dublin 2 to regularise title to an existing sub-station site adjacent Neilstown Boxing Club premises at Neilstown, Clondalkin, Dublin 22 together with a right of way over adjacent Council owned lands to access same. The County Architect has reported that the sub-station site has been operational since 2010 when the Neilstown Boxing Club was extended but the formal transfer of title to the site to the E.S.B. was not completed at that stage.
Accordingly, I recommend that the Council dispose of its interest in the sub-station site as shown outlined in red on Indicative Drawing No. 3261-19, together with a grant right of way over the area shaded yellow on the Drawing to the Electricity Supply Board in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 subject to the following terms and conditions:-
1. That the Council dispose of its interest in the subject plot as shown outlined in red on Indicative Drawing No. 3261-19 for the consideration of €10 (ten euro).
2. That the Council grant the ESB a right of way over the area shown shaded in yellow on Indicative Drawing No. 3261-19 to access the sub-station site.
3. That the sub station site is disposed of with full freehold title.
4. That the ESB shall pay a contribution in respect of the Council's legal fees.
5. That the Law Agent shall draft the necessary documents and shall include any further terms he deems appropriate in agreement of this nature.
6. That no contract enforceable at law is created or intended to be created until such time as contracts have been exchanged.
7. That the disposal is subject to the necessary approvals and consents being obtained.
The lands being disposed of form part of the lands acquired from Dublin City Council (formerly Dublin Corporation) in 1997 under the Scheme of Transfer of Lands and Houses pursuant to the Local Government (Dublin) Act, 1993.
