MOTION NO. 6

MOTION: Councillor W. Lavelle

"That this Area Committee requests the Manager to formally write, on behalf of this Committee, to Mr. Paul McCann of Grant Thornton (in his role as the Receiver appointed to manage the former Maplewood lands at Adamstown SDZ) to ask if he would agree to authorising works in response to the long-standing requests from the residents of Dodsboro Cottages and from this Committee for a more attractive boundary treatment between the undeveloped lands south of The Paddocks and Dodsboro Road/Tandys Lane; and to further advise Mr. McCann that members of this Committee are available to meet with him on-site to further discuss this matter."

REPORT:

In relation to the houses already constructed in the Paddocks that front onto Dodsboro Road/Tandys Lane., these dwellings were permitted under SDZ07A/0001. This permission expires on the 21st August 2017 and all boundary treatment and landscaping must be completed before the permission expires.

The lands located to the south of the Paddocks that front onto Dodsboro Road/Tandys Lane and which remain undeveloped at present were subject to planning permission under SDZ08A/0005. This permission expired on the 4th September 2013 and no active permission remains for this section of the lands at present.  Given that there is no planning permission pertaining to these lands and no development has occurred to date on these lands, there is no planning requirement for  boundary treatment . When planning applications are lodged, the treatment of these boundaries will be addressed as part of any grant of permission At this time the developer is not obliged to carry out improvement works to these boundaries.

Should there be specific matters of concern with regard to the site boundary in question, e.g. safety or security, it is requested that the Committee would provide further details to enable them to be raised with the Reciever.
