Development company in receivership and
Council have settled a claim with the surety for
the full costs of bringing services to TIC
standard. The development has been advertised
for taking in charge on the 25/10/2013. This
matter will be considered by SDCC at its
February 2014 Council meeting.

Valid taking in charge request received for
development. Process of costing remediation
works ongoing. Security in place to part fund
works. In the interests of cost saving, the
statutory process (advert etc) will commence
when a number of other developments are ready
to be taken in charge, possibly April/May
2014.

Mixed Residential development. No taking in
charge request yet received and security in
place. Parent planning permission is for 10
years and does not expire until Sept 2015,
revised permissions do not expire until 2019.
Utilising security or enforcement are
compromised while the permissions are live.
Receiver appointed Jan 2012 only for part of
the development. Receiver advised that not
all security will be released as the security is
for the full development, not only that in
receivership.
The receiver has advised of intention to fund
taking in charge works from recent house sales
and has carried out some works in the estate,
notably safety works to boundaries of the
building site. The technical requirements of
taking in charge process have been outlined to
the receiver and CCTV has been completed. In
parallel to this, as-built details of the
remaining underground network, site layout,
public open space, public lighting are being
completed as part of taking in charge
obligations. Meanwhile Kingscroft are
continuing to develop the 30+ house site to
the South-East of the Roundabout.
Realistically, the timing of the completion of
the Kingscroft infill development, the
proving of all underground networks,
preparation and approval of all as-built
drawings, surfacing of remaining roads should
all coincide in the summer-autumn of 2014.
G ESTATES UNDER CONSTRUCTION/CONSTRUCTION CEASED:

Development
Mixed Residential Development for 182 units Ltd
granted by An Bord Pleanala. Further
extension of duration granted to Feb 2015.
The bond for the development remains in
place. Management Agreement submitted. No
taking in charge request from developer and
approximately 100 of the units in the
development are constructed and the
permission is still active. The developers
received planning permission for a revised
layout to part of this scheme recently, SD13A/0005.
This development will most likely commence in the
coming months. Given that certain roads are
shared between existing and proposed
development and that the storm and foul water
systems are shared, it would be premature to
discuss taking in charge until the development
is complete as while construction will be
ongoing a risk to services would exist were
they taken in charge.

K PRIVATE DEVELOPMENTS(NO TIC REQUEST)
11 Crannagh Way Rathfarnham Grovewood
Contractors Ltd.
Crannagh Way contains 11 semi detached
units built around 1996/97. Access to the
development is through Crannagh Grove/Road
which was itself taken in charge in 1986.
The planning permission stated that the
development was to be private and conditions
required the establishment of a management
structure for ongoing service maintenance.
The development was carried out by
Grovewood Contractors however it was never
offered for taking in charge. There was no
condition requiring lodgement of security
applied by An Bord Pleanala who granted
permission under 06S.099068. No record of
bond or security lodged exists. As the
statutory period for the taking of enforcement
action has expired a number of years, the
Council cannot compel the developer to
complete the development.
Initial surveys of surface defects that would
have to be remedied in order to bring the
development to taking in charge standard are
approximately €45,000, with public lighting
standards being the main issue.
The house owners may offer the services to be
taken in charge but funds will have to be
identified to complete taking in charge
remediation.
