MOTION NO. 3
MOTION: Councillor A.M. Dermody
"That the Manager explain what is involved in changing the by-laws so as to prevent deliveries to the front of Tesco outside of normal delivery times. This complaint comes from a resident living in Fairways and so far I believe that the Management of Tesco is merely providing lip-service to this resident in the hope that they will wear him down. It is time now that this Council take a reactive step and given that there has been no positive shift by Tesco in the delivery routine since this complaint was placed on the agenda for this meeting, it now falls to us as Councillors to amend/vary the by-laws to ensure that rights of residents to a good night sleep is respected, represent the interest of this constituent, and to demand and enforce change."
REPORT:
It is understood that the matter referred to in the motion relates to lands in private ownership. By-laws are adopted by the Council and generally relate to matters within areas of public ownership or control.
Notwithstanding this, the matter is the subject of an ongoing investigation by the Environmental Health Department. The Environmental Health Department arranged and chaired a meeting recently at the site between the relevant parties to discuss possible solutions. One possible solution is a new delivery point for the produce and this has been investigated since the end of December. There is one heavy goods vehicle movement each night. This solution will be subject to the results of a noise survey and the agreement of the Management Company for the Shopping Centre. The progress in reaching a solution is being monitored by the Environmental Health Department who are mindful that any new solution must be for the good of all residents in the vicinity of this shopping centre. The Councillor will be kept informed of progress.
