REVIEW OF CONTROL OF HORSES BYE - LAWS

REPLY:

Section 46 of the Control of Horses Act 1996 provides that 'A local authority may make bye-laws for the control and welfare of horses in the whole or part of its functional area.'

In accordance with the provisions of S.200 of the Local Government Act 2001, notice of intention to make the Bye-law was published in the Echo newspaper on the 3rd October 2013. The draft Bye-laws were made available for inspection  at the offices of South Dublin County Council during the period from the 7th October up to and including the 15th November 20l3; the final date notified for making of  submissions on foot of the draft bye-laws was the 25th November 20l3. No submissions were received. 

A report on the matter was presented to the Environment Strategic Policy Committee at it's meeting on 2nd December 2013. Following consideration the matter was deferred to the Committee's next meeting held on 3rd February 2014 at which it was agreed to recommend the draft Bye Laws with modifications go forward for adoption by the County Council.

It is hereby recommended that in exercising powers conferred by Sections 13, 17, 39 and 40, 46 and 47 of the Control of Horses Act, 1996 (No. 37 of 1986), and in accordance with S.200 of the Local Government Act 2001, the South Dublin County Council (Control of Horses) Bye-Laws, 2014 as presented be made.
