Report on Laneway at rear of Willbrook Park
The possibility of granting use of the area at the rear of house numbers 2 to 14 inclusive to the owners and occupiers for gardening purposes is being actively pursued and the matter has been referred to our Housing and Environmental Services Departments for their consideration.
Under the proposal each resident would incorporate the land to the rear of their back garden into their property by extending their garden to meet the wall at the back garden wall of the houses in the estate behind. They would have the beneficial use of the land under a caretakers agreement only but would not get title to the land ie the council would retain the legal title to the land.
Strict conditions would apply viz:
The land may ever be used for gardening purposes only;
No buildings may be built on the land--(timber garden sheds shall be permitted);
The boundary treatment between the incorporated plots shall comprise post and plank or timber fencing only---no garden walls may be built;
The council shall have free and unencumbered access to the land with minimal notice if and when they need to carry out maintenance or repair works to the pipe buried under the land;
In such an eventuality no compensation shall be payable to the residents;
The residents shall pay the full costs of the incorporation ie the boundary treatment and for the levelling and cultivation of the land.
The residents shall undertake to take care not to damage the watermain when gardening.
Provided the Housing and Environmental Services Departments are agreeable to this proposal, the residents will be contacted to ascertain who is interested.
Since the last meeting the area has been cleared and cleaned and a new lock has been provided. Keys to the lock will be given to the local householders immediately.
