MOTION NO. 3
MOTION: Councillor B. Bonner
That this Committee expresses concern at the manner in which a particular outlet on Main Street, Clondalkin conducts it's business i.e. trading from the pavement and requests the Manager to present a report on the matter which should refer to the following:
Display of goods for sale on the pavement and shopfront.
Can a trader conduct business immediately outside his shop premises.
If all of these activities are permissible, what recourse is open to residents who find this way of conducting business objectionable.
REPORT:
An inspection has been carried out of premises along Main Street, Clondalkin and a notice under Section 71 of the Roads Act requesting that goods for sale from the footpath be removed has issued. Follow up action will be taken as necessary.
Previous advice from our Legal Department has advised that legally there is nothing we can do about the shop owner sitting outside the shop and drawing business into the shop from this location. It is acknowledged that this way of doing business is unorthodox.
There may be recourse to discuss the matter locally outlining concerns and to achieve an acceptable outcome.
